Ex-Wamco Employee Sentenced Over Email Intrusions

The criminal court case about an ex-Wamco [profile] employee's unauthorized email use has come to a close, though on the other side of the country.

Yesterday in Manhattan in the U.S. District Court for the Southern District of New York, U.S. Magistrate Judge Henry Pitman sentenced Kristopher Rocchio to "one year of probation, 100 hours of community service" and ordered Rocchio "to pay $39,095 in restitution," Reuters' Nate Raymond reports. Federal prosecutors had pushed for up to a year in prison for Rocchio, 39, who pled guilty in March to a misdemeanor, unauthorized computer intrusion, for repeatedly accessing his former Wamco supervisor's email account.

Rocchio left Legg Mason fixed income giant Wamco in 2012 (an unnamed source previously told the Wall Street Journal that Rocchio was fired). December 8, 2015, federal prosectors (led by Preet Bharara, the U.S. Attorney for the Southern District of New York) charged Rocchio with computer fraud (see the complaint), and Rocchio was reportedly arrested the next day. Rocchio was accused of accessing his former Wamco's boss's email account over 100 times between 2012 (when Rocchio left Wamco) and February 2015.

Rocchio's email intrusions were only discovered in February 2015, when the former supervisor in question noticed an email bounceback message for an email that the supervisor didn't remember sending.

"He and his supervisor didn't get along, and he wanted to see if he was speaking bad about him," Steve Feldman, Rocchio's lawyer, reported said in March 2016 when Rocchio pled guilty and read a statement in court.
