The pending Supreme Court case involving Gabelli funds got some major league Beltway press this week, with a fairly lengthy article on the upcoming showdown being published in the
Washington Post.
Gabelli v. SEC, covered in September by
MFWire, will be argued in front of the justices on January 8, according to the
Post.
PM Marc Gabelli and COO Bruce Alpert are claiming that the SEC waited too long to file charges against them for market timing. According to reporter Dina ElBoghdady, if Gabelli wins, it could force toe SEC to expedite cases.
“This would be a substantial shift for the SEC,” said John C. Coffee Jr., a law professor at Columbia Law School, to the
Post “It would put them behind the eight ball.”
