Gundlach and TCW Prepare for a Trial


Fundsters interested in the continuing battles between DoubleLine [see profile] chief Jeff Gundlach and his former employer, TCW [see profile], may want to keep an eye on the courtroom of Los Angeles Superior Court Judge Carl West. Bloomberg's Edvard Pettersson reports that TCW's initial trade secrets suit against Gundlach is now slated for a jury trial on July 25 under West's eye, and a trial on Gundlach's breach-of-contract countersuit could be next.

West tentatively tossed TCW's claim of breach of duty of confidence and its claims related to the California penal code, while leaving on the table allegations of gross misconduct, theft of trade secrets and confidential information, and violation of fiduciary duties.

As for Gundlach's countersuit (technically a cross-complaint under California law), TCW asked West to toss Gundlach's breach-of-contract claims, yet prior to yesterday's hearing West tentatively decided to let the countersuit move forward. The jury will hear both TCW's claims and DoubleLine's counterclaims in the same trial.
